Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of Big Earnie, a professional services estimation application (the "Service"). By signing in or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Big Earnie helps teams create, manage, and explain project estimates, staffing plans, and related engagement data. The Service may include AI-assisted features, integrations, and API access. We may update, modify, or discontinue features at any time.
3. Accounts and access
Access to the Service is provided by invitation or administrator approval. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information and notify your administrator if you suspect unauthorized access. If you are not the administrator of the account, you must contact the administrator to request access.
4. Acceptable use
You agree not to:
- Use the Service in violation of applicable law or third-party rights
- Attempt to gain unauthorized access to the Service, other accounts, or related systems
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, scrape, or misuse the Service except as expressly permitted
- Upload malicious code or use the Service to store unlawful content
5. Your data and estimates
You retain ownership of the business data, estimates, and content you submit to the Service. You grant us the rights necessary to host, process, back up, and display that content solely to operate and improve the Service.
Estimates, staffing plans, and financial projections generated in Big Earnie are tools to support planning and discussion. They are not guarantees of project outcomes, costs, or profitability. You are responsible for reviewing outputs before relying on them in client, contractual, or financial decisions.
6. AI-assisted features
Some features use automated or AI-based systems to suggest staffing plans or other outputs. These suggestions may be incomplete or inaccurate. You are responsible for validating AI output before applying it to live estimates, statements of work, or client communications.
7. Third-party services
The Service may integrate with third-party identity providers (such as Google or Microsoft), hosting providers, and other tools. Your use of those services is subject to their own terms and privacy policies.
8. Confidentiality
You may have access to confidential information belonging to your organization or its clients through the Service. You agree to use that information only for authorized business purposes and to protect it in accordance with your organization's policies.
9. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIG EARNIE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
11. Termination
We may suspend or terminate access to the Service at any time for violation of these Terms, security concerns, or discontinuation of the Service. Your organization may also revoke your access at any time.
12. Changes
We may revise these Terms from time to time. Material changes will be reflected on this page with an updated "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
